When you place an order, you are making an offer to purchase. Seek & Rummage reserves the right to accept or decline an order for any lawful reason. An order is not accepted until we confirm its acceptance and receive and process the applicable payment.

Please review your order carefully before submitting it. We may be unable to accommodate cancellation requests after an order has been accepted.

If we decline, modify, or cancel an order, we will attempt to notify you using the email address, billing address, or telephone number provided with the order.

Unless otherwise agreed by us in writing, purchases made through our retail store are intended for personal or household use and not for commercial resale or export.

Delivery dates and transit times are estimates unless we expressly state otherwise.

We are not responsible for delays caused by shipping carriers, customs processing, weather, emergencies, or other circumstances outside our reasonable control. However, we will comply with applicable laws concerning shipment timing, delay notifications, cancellations, and refunds.

If an order cannot be shipped within the promised timeframe, we will provide any notice and options required by applicable law.

These Terms permit you to use the Services for personal, noncommercial purposes only. Except as permitted by law or authorized by us in writing, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit material from the Services.

Nothing in these Terms grants you a license or ownership interest in any patent, trademark, copyright, or other intellectual property belonging to Christina Reed Enterprises LLC, Seek & Rummage, BlaKayEmmCo, Shopify, or another party. All rights not expressly granted are reserved.

Seek & Rummage™, Seek’ems™, and associated names, logos, product and service names, designs, characters, artwork, game content, packaging, and slogans are trademarks, copyrighted materials, or other intellectual property owned by or licensed to Christina Reed Enterprises LLC. They may not be used without prior written permission.

Shopify’s names, logos, product and service names, designs, and slogans are trademarks of Shopify. Other names, logos, products, services, designs, and slogans displayed through the Services belong to their respective owners.

SECTION 7 — OPTIONAL TOOLS

We may provide access to tools supplied by third parties that we do not monitor or control.

Access to such tools is provided “as is” and “as available,” without warranties, representations, endorsements, or conditions of any kind to the fullest extent permitted by law.

Seek & Rummage is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are transactions directly between you and Christina Reed Enterprises LLC, doing business as BlaKayEmmCo and operating the Seek & Rummage store.

By using the Services, you acknowledge that Shopify is not responsible for sales between you and Seek & Rummage, including injuries, damages, or losses resulting from products or services purchased from Seek & Rummage.

To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or relating to purchases and transactions made with Seek & Rummage.

If you submit, upload, post, email, or otherwise transmit ideas, suggestions, feedback, reviews, proposals, plans, photographs, or other content (collectively, “Feedback”), you grant Christina Reed Enterprises LLC, doing business as BlaKayEmmCo, a worldwide, nonexclusive, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback for purposes related to operating, evaluating, improving, and promoting the Services.

WE DO NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OR ALL OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

SECTION 17 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CHRISTINA REED ENTERPRISES LLC, DOING BUSINESS AS BLAKAYEMMCO AND OPERATING THE SEEK & RUMMAGE STORE, AND ITS OWNERS, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOST DATA, OR REPLACEMENT COSTS, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF THE POSSIBILITY OF SUCH DAMAGES WAS DISCLOSED.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Christina Reed Enterprises LLC, doing business as BlaKayEmmCo and operating the Seek & Rummage store, Shopify, and their respective owners, affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, losses, damages, and reasonable legal expenses arising from:

Your material breach of these Terms.
Your violation of applicable law.
Your violation of another party’s rights.
Your misuse of the Services.

We will provide reasonable notice of an indemnifiable claim. Failure to provide prompt notice will not relieve you of your obligations unless the delay materially prejudices your ability to respond.

We may control the defense and settlement of a covered claim at our expense or as otherwise permitted by law. We will not agree to a settlement that imposes nonmonetary obligations upon you without your reasonable consent.

SECTION 19 — SEVERABILITY

If a provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with the policies and operating rules posted through the Services, constitute the entire agreement concerning your use of the Services and supersede prior or contemporaneous agreements, communications, and proposals concerning that use.

You may not transfer or assign these Terms or your rights or obligations under them without our prior written consent.
